Housing Disrepair Claims FAQs

I’m not sure if I have a valid claim. Can you help?

Yes. If you've reported repair issues to your housing association, council/local authority landlord, and they haven’t been resolved in a reasonable time, you may be eligible to claim. Even if you're still living in the property and the issue is ongoing, you could be entitled to both repairs and compensation.

Premier Legal Assist is a claims management company. We connect you with experienced solicitors who can help enforce your rights and pursue compensation on a no-win, no-fee basis. You may also complain directly to the Housing Ombudsman.

What is the process for making a housing disrepair claim?

Begin by completing our brief online claims form to describe the issues in your rented home. Then we'll call for a free, no-obligation consultation to find out:

  • What problems you've raised
  • How long they’ve persisted
  • Your social landlord’s response (if any)
  • Effects on your health, home, or possessions

If your case is eligible, we’ll refer you to a specialist housing disrepair lawyer who will manage the claim, from gathering evidence to negotiations or legal proceedings, all on a no-win, no-fee basis.

Why choose Premier Legal Assist for your housing disrepair claim?

We’ve helped tenants across the UK take legal action when landlords fail in their responsibilities. Here’s what you get with us:

  • Access to specialist and experienced no-win, no-fee legal support
  • Fair compensation for your suffering and losses
  • Repairs arranged through trusted legal channels
  • A helpful, transparent service from day one

Premier Legal Assist is a claims management company. You do not need to use a claims management company to make your complaint, you can complain to your landlord or refer it to the Housing Ombudsman yourself for free.

What will it cost me to make a claim against my landlord?

There’s no upfront cost to you. If your claim is successful, your solicitor will deduct a success fee, usually up to 25%, from the final compensation. This will be explained clearly before you proceed. Please note: If you cancel after the 14-day cooling-off period, a cancellation fee may apply.

How long does the claims process take?

Each case is unique - the time it takes to resolve repair issues or a claim depends on several factors:

  • The severity of the disrepair
  • How long the issue has been ongoing
  • How cooperative your landlord is in dealing with the case
  • Whether Court proceedings are needed

If they take on your case, your solicitor will give you a clear timeline and keep you updated throughout the process.

What kind of compensation could I receive?

Your solicitor will advise you on the types of compensation that you may receive should your claim be successful. Again, each case is unique - compensation is assessed based on your individual circumstances, but you may be able to claim for:

  • Loss of enjoyment or use of your home
  • Damage to personal belongings or furniture
  • Illness caused by mould, cold, or damp
  • Emotional distress, stress or inconvenience

Who is the Housing Ombudsman?

The Housing Ombudsman is a free, independent service that helps resolve disputes between tenants and social landlords. If you've reported disrepair or other housing issues and feel your landlord hasn’t dealt with them properly, you can escalate your complaint to the Ombudsman.

The Ombudsman can investigate your case, issue findings, and recommend that the landlord take action or offer compensation. However, this process can take several months and doesn’t always lead to urgent repairs being carried out quickly.

At Premier Legal Assist, we connect tenants with specialist disrepair solicitors who can take legal steps to force repairs and claim compensation on a no-win, no-fee basis.
